RM - 1353586, email: mail.comsrl@gmail.com . I dati sono trattati presso gli account cloud google e dropbox.

In caso l’Utente effettui un ordine relativamente ad un prodotto/servizio presente sul nostro sito, il produttore/distributore/rivenditore di detto prodotto/servizio è da considerarsi Responsabile del trattamento dei medesimi dati personali ad esso forniti per l’adempimento del relativo ordine. I dati sono quindi altresì trattati presso la sede di ciascuno di essi. In ogni caso, questi soggetti e tutti coloro che saranno eventualmente partecipi di tali dati personali saranno vincolati al rispetto della nostra politica di riservatezza vigente e rinvenibile sul nostro sito web.

Raccogliamo i dati personali per fornire e migliorare i nostri Servizi. Di seguito sono elencate le categorie di dati personali che raccogliamo:

1 - Dati di navigazione/tecnici

I sistemi informatici e le procedure software preposte al funzionamento di questo sito web acquisiscono, nel corso del loro normale esercizio, alcuni dati la cui trasmissione è implicita nell’utilizzo dei protocolli di comunicazione di Internet. In questa categoria di dati rientrano, tra l’altro, gli indirizzi IP o i nomi a dominio dei computer utilizzati dagli utenti che si connettono al sito ed altri parametri relativi al sistema operativo e all'ambiente informatico dell'Utente. 

Grazie agli accorgimenti tecnici da noi adottati e descritti in seguito, questi dati vengano utilizzati al solo fine di ricavare informazioni statistiche anonime sull'uso del sito, per controllarne il corretto e migliore funzionamento e per prevenire abusi. I dati potrebbero essere utilizzati per stabilire la responsabilità in caso di reati informatici commessi contro il sito web.

2 - Dati forniti dall’Utente

Raccogliamo le informazioni personali che l’Utente ci fornisce volontariamente quando utilizza/si registra ai nostri Servizi, esprime un interesse ad ottenere informazioni su di noi o sui prodotti/servizi nostri e di terzi promossi sul nostro sito, quando partecipa ad attività relativa ai Servizi o altrimenti quando ci contatta. Le informazioni personali che raccogliamo dipendono dal contesto delle interazioni con noi e con i Servizi, dalle scelte fatte dall’Utente e dalle funzioni che utilizza. Le informazioni personali che raccogliamo possono includere quanto segue: nome, cognome, indirizzo email, indirizzi e dati di fatturazione, numero di telefono.

Il nostro sito web utilizza i dati personali dell’Utente registrato per creare automaticamente un profilo delle sue preferenze di acquisto e consentire allo stesso di poter usufruire di tutti i servizi offerti dai nostri canali web.

È molto importante la collaborazione attiva dell’Utente registrato. Questi deve adottare misure adeguate ad impedire l'accesso non autorizzato alla sua password e ai suoi dispositivi. A tal fine consigliamo di usare una password unica (non utilizzata altrove) per l’accesso al nostro account.

I dati forniti dall’Utente al momento dell'ordine di beni e/o servizi saranno trattati al fine di evadere il suo ordine. Si prega di notare che gli ordini non potranno essere elaborati e gestiti senza fornire i dati che verranno richiesti. La base giuridica di questo trattamento è l’art. 6 par. 1 lett. b) GDPR. 

Una volta completato l’ordine, i dati personali dell’Utente non registrato verranno cancellati ma solo dopo l’esecuzione dell’ordine stesso e, comunque, allo scadere dei periodi di conservazione richiesti dalla legge. 

È bene inoltre sottolineare che l’utilizzo di sistemi di pagamento online per l’acquisto di un prodotto/servizio richiede necessariamente la condivisione di alcuni dati personali con il fornitore dei servizi di pagamento nella misura necessaria per elaborare il relativo pagamento. La base giuridica di questo trattamento è l’art. 6 par. 1 lett. b) GDPR.

3 – Trattamento di categorie particolari di dati personali (“dati sensibili”)

La Ditta non tratta categorie particolari di dati personali ex Art. 9 – GDPR (cd. “dati sensibili”).

FINALITÀ DEL TRATTAMENTO DEI DATI E BASE GIURIDICA

I Dati personali comunicati dall’Utente e i dati tecnici di navigazione eventualmente raccolti dal sito, sono trattati per le finalità e mediante le modalità qui di seguito riportate.

In base a quanto già indicato, i dati personali tratti da questo sito web sono trattati previo consenso espresso ai sensi dell’art. 6, par 1, lett. a) GDPR, attraverso accorgimenti tecnici adeguati. La base giuridica è altresì fondata sull’esecuzione di un contratto ex art. 6, par. 1, lett. b) GDPR e su interessi legittimi ex Art. 6, par. 1, lett. f) GDPR. I nostri interessi legittimi risiedono nel miglioramento dell’esperienza dell’Utente e della qualità dei servizi offerti tramite il nostro sito web, nella sua sicurezza e difesa da accessi automatici indesiderati sotto forma di spam o simili nonché nell'analisi, comunicazione, vendita e promozione dei prodotti e servizi nostri o di soggetti terzi sponsorizzati.

Tali dati sono da noi utilizzati per le finalità qui di seguito riportate: 

MODALITÀ DI TRATTAMENTO DEI DATI

Il trattamento dei dati personali raccolti dalla Ditta tramite questo sito web avviene mediante strumenti manuali, informatici e telematici, con logiche strettamente correlate alle finalità stesse e comunque in modo da garantirne la sicurezza e la riservatezza nel rispetto della normativa vigente.

La Ditta si impegna a custodire e controllare gli stessi in maniera tale da ridurre al minimo i rischi di distruzione o perdita, di accesso non autorizzato o di trattamento non consentito o non conforme alle finalità per cui sono stati raccolti. A tal fine abbiamo implementato misure di sicurezza tecniche e organizzative adeguate e ragionevoli, volte a proteggere la sicurezza delle informazioni personali trattate. È comunque bene rendere noto che, nonostante tutti i nostri sforzi ed accorgimenti, nessuna trasmissione elettronica su Internet o tecnologia di archiviazione delle informazioni può essere garantita come sicura al 100%. Non possiamo quindi garantire che criminali informatici o altre terze parti non autorizzate non saranno in grado di bypassare la nostra sicurezza e accedere/prelevare/alterare le informazioni degli Utenti. È pertanto doveroso affermare che la trasmissione di informazioni personali da e verso i nostri Servizi è a rischio dell’Utente.

I dati personali raccolti dai partner/sponsor/strumenti tecnici di terze parti collegati al nostro sito web sono trattati in base alle rispettive politiche sulla riservatezza di cui noi non siamo responsabili. L’Utente deve informarsi delle varie politiche sulla riservatezza applicate prima di aderire ad un servizio offerto tramite internet.

CATEGORIE DI DESTINATARI DEL TRATTAMENTO DEI DATI

La tutela dei dati relativi agli Utenti è una priorità della nostra attività e, pertanto, non vendiamo a terzi i loro dati personali. La Ditta comunica i dati personali degli Utenti solo come indicato qui di seguito. Ad ogni modo, tali dati sono comunque soggetti o alla presente Informativa sulla privacy o comunque a procedure che prevedono tutele analoghe a quelle descritte in questa Informativa.

Per lo svolgimento delle finalità predette, i dati personali dell’Utente possono essere comunicati a soggetti coinvolti nell’organizzazione e gestione della Ditta (ad es. personale amministrativo, commerciale, legali, commercialisti, amministratori di sistema, etc.). A tali soggetti terzi verranno fornite solamente le informazioni necessarie all’espletamento delle relative funzioni; essi tratteranno i dati quali responsabili pro tempore del trattamento nel rispetto della presente informativa e della normativa vigente.

I dati personali forniti dall’Utente al momento dell’ordine di un prodotto/servizio presente sul nostro sito sono comunicati altresì ai soggetti coinvolti nell’esecuzione dell’ordine stesso (come, ad esempio, al produttore, distributore, rivenditore, spedizioniere, etc.). Questi provvederanno a trattare ed elaborare tali dati personali, in qualità di Responsabili, con riferimento all’ordine espresso dall’Utente e ad eseguire quant’altro richiesto dal contratto.

Inoltre, come sopra anticipato, l’acquisto di un prodotto/servizio richiede necessariamente la condivisione di alcuni dati personali con il fornitore dei servizi di pagamento nella misura necessaria per elaborare il relativo pagamento.

Inoltre, potremmo aver bisogno di condividere o trasferire le informazioni dell’Utente in caso di modifiche alla natura giuridica della nostra attività oppure in relazione a o durante le trattative relative a qualsiasi fusione, vendita di beni aziendali, finanziamento o acquisizione di tutta o parte della nostra attività a soggetti giuridici terzi. I dati relativi agli Utenti, essendo parte del patrimonio aziendale che viene trasferito, rimarranno comunque soggetti al contenuto dell’Informativa sulla privacy da essi accettata ed eventualmente applicabile salvo che l’Utente non disponga diversamente.

Comunicheremo i dati relativi all'Utente registrato e altri dati personali qualora ritenessimo che tale comunicazione sia conforme ad obblighi di legge, per far rispettare e/o applicare le nostre Condizioni Generali e/o altri accordi e/o per tutelare i diritti, il patrimonio nonché la sicurezza della Ditta, dei nostri Utenti e/o di altri soggetti. Ciò potrebbe ricomprendere lo scambio di informazioni con altre società ed organizzazioni che provvedono alla prevenzione di frodi o alla riduzione del rischio relativo al credito.

PERIODO DI CONSERVAZIONE DEI DATI

Tutti i dati personali forniti sono conservati per il tempo strettamente necessario a rispondere alle richieste effettuate dagli Utenti e a raggiungere gli scopi indicati nella presente informativa a meno che un periodo di conservazione più lungo non sia richiesto o consentito dalla legge (ad es. per obblighi fiscali, contabili o altri requisiti legali). Inoltre, se l’Utente si è registrato con Account Cliente, i dati saranno conservati a fini statistici per conservare la cronologia delle transazioni in modo che l’Utente possa esaminare gli acquisti effettuati. Ciò avverrà fintanto che l’Utente registrato non eserciti il suo diritto di disiscrizione, momento in cui i dati raccolti saranno eliminati. 

Quando non avremo più la legittima necessità di trattare le informazioni personali dell’Utente, queste saranno cancellate o rese anonime oppure, se ciò non fosse possibile (ad esempio, perché le informazioni personali sono state memorizzate in archivi di backup), conserveremo in modo sicuro le informazioni personali dell’utente e le isoleremo da qualsiasi ulteriore trattamento fino a quando non sarà possibile cancellarle.

In ogni caso, i dati verranno eliminati quando l’Utente esercita il diritto di cancellazione degli stessi a condizione che la cancellazione non sia in contrasto con le necessità di archiviazione previste dalla legge. 

I dati di navigazione/tecnici sono conservati per il tempo descritto nella nostra Cookie Policy. 

DIRITTI DELL’INTERESSATO

I soggetti cui si riferiscono i dati personali hanno il diritto a che i loro dati siano trattati in modo lecito, corretto e trasparente. Inoltre, hanno diritto, ove possibile ed in qualunque momento:

- di essere informati su come vengono utilizzati i dati personali come, ad esempio tramite la presente informativa sulla privacy.

- di richiedere l’accesso (art. 15), la rettifica (art. 16) o la cancellazione (art. 17) dei dati personali che deteniamo. Può altresì chiedere la limitazione del trattamento che lo riguarda (art. 18), oltre al diritto alla portabilità dei dati (art. 20).

- di revocare il consenso prestato in qualsiasi momento (art. 7) senza pregiudicare la liceità del trattamento basata sul consenso prestato prima della revoca. Si fa presente che qualora l’Utente opti per revocare il consenso, ciò potrebbe influire sulla corretta e corrente gestione degli eventuali rapporti precontrattuali e contrattuali dell’Utente con MU. In particolare, il consenso espresso dall’Utente all’utilizzo dei cookies può essere revocato in ogni momento uscendo dal sito e cancellando la cronologia ed i cookies dal browser utilizzato per accedere ad internet (le modalità sono state indicate nella sezione “Cookie Policy”). Il consenso al trattamento dei dati forniti attraverso il modulo di contatto e a seguito di contatto mail o telefonico può essere effettuato anche comunicando tale intenzione con il medesimo modulo di contatto o via mail al seguente indirizzo e-mail mail.comsr@gmail.com .

- di opporsi in qualsiasi momento, per motivi connessi alla sua situazione particolare, al trattamento dei dati personali che lo riguardano ai sensi dell'articolo 6, paragrafo 1, lettere e) o f), in particolare se effettuato per finalità di marketing diretto (art. 21).

- Qualora infine l’Utente ritenga che il trattamento che lo riguarda violi la normativa vigente in materia, ha il diritto di proporre Reclamo (art. 77) ad un'autorità di controllo, segnatamente nello Stato membro in cui risiede abitualmente, lavora oppure del luogo ove si è verificata la presunta violazione. Per l’Italia tale autorità è il “Garante per la protezione dei dati personali”, istituito dalla legge 31 dicembre 1996, n. 675 (http://www.garanteprivacy.it).

L’Utente può ottenere ulteriori informazioni sui suoi diritti incluse le circostanze in cui si applicano rivolgendosi all’autorità di controllo dello Stato membro in cui risiede abitualmente.

INFORMAZIONI SUL TRATTAMENTO DEI DATI

Sistemi di racconta dei dati forniti volontariamente dall’Utente:

Modulo di contatto, posta elettronica, contatto telefonico.

Si tratta dei dati forniti volontariamente ed esplicitamente dall’Utente del sito attraverso il modulo di contatto presente nel sito web o attraverso l’invio di posta elettronica agli indirizzi indicati, o tramite contatto telefonico. Ciò comporta l’acquisizione di alcuni dati che consentono l’identificazione dell’interessato e che sono necessari per rispondere alle richieste, nonché di altri eventuali dati personali inseriti nel corpo del testo della comunicazione. La base giuridica per questo trattamento dei dati è l'articolo 6 par. 1 lett. f) GDPR. Il nostro interesse legittimo risiede nella corretta gestione della fase precontrattuale. Il mancato consenso comporta l’impossibilità di svolgere i servizi offerti tramite il nostro sito web.

Registrazione di un Account Cliente

L’Utente può creare un Account Cliente attraverso la procedura di registrazione prevista nel nostro sito web, servizi, pubblicazioni o app anche passando dai social network che, in tal caso, condivideranno i dati in loro possesso. I dati inseriti durante la registrazione (ad es. nome e cognome, indirizzo e/o e-mail) saranno utilizzati esclusivamente per consentire allo stesso Utente di accedere ai servizi per l'inserimento di un ordine o l’attivazione di altro rapporto contrattuale con la Ditta o all’acquisto di prodotti di terzi, per evadere tali ordini o contratti e per fornire assistenza all’Utente (ad es. per poter acquistare un prodotto sponsorizzato, ricordargli l’iscrizione e/o un “carrello abbandonato”, fornire una panoramica degli ordini precedenti, indicare - salvo opt-out - prodotti analoghi a quelli acquistati, notificargli la disponibilità di un prodotto o altro servizio offerto sul sito). In tali casi sarà memorizzato anche l’indirizzo IP, la data e l'ora della registrazione. Questi dati saranno trasferiti a terzi solo in caso di esecuzione di un ordine di acquisto dell’Utente. 

Durante il processo di registrazione verrà raccolto il consenso a tale trattamento dei dati, con riferimento alla presente Privacy Policy. I dati da noi raccolti verranno utilizzati esclusivamente per creare l’Account Cliente e consentire l’interazione dello stesso con i servizi offerti. Se l’Utente presta consenso a questo trattamento, la base giuridica è l'articolo 6 par. 1 lett. a) GDPR. Qualora l’apertura di un Account Cliente è finalizzata anche a portare all'avvio di un rapporto contrattuale e all'adempimento di un contratto anche preesistente, la base giuridica per questo trattamento è altresì l'articolo 6 par. 1 lett. b) GDPR al quale si aggiunge l'articolo 6 par. 1 lett. f) GDPR. Il nostro interesse legittimo risiede nel poter promuovere i prodotti e i servizi anche dei terzi sponsorizzati sul nostro sito web e nella corretta gestione della fase precontrattuale.

È possibile revocare in qualsiasi momento il consenso al trattamento dei dati personali ai sensi dell'articolo 7 par. 3 GDPR con efficacia dalla richiesta inoltrata alla seguente email mail.comsr@gmail.com. In ogni caso, i dati precedentemente raccolti anche a seguito di iscrizione al sito verranno poi cancellati non appena il trattamento non sarà più necessario, salvo comunque il rispetto di eventuali periodi di conservazione richiesti dalla legge.

Chatbot di Intelligenza Artificiale

Il nostro sito web implementa chatbot di intelligenza artificiale che si appoggiano a ChatGPT, un software sviluppato da “OpenAI” e progettato per simulare una conversazione con un essere umano al fine di generare testo. Il suo funzionamento si basa su un modello di elaborazione del linguaggio naturale (NLP) sviluppato dalla stessa “OpenAI”. Questo bot consente all’utente registrato di interagire con i Chatbot IA e avere un’esperienza immersiva qualificata, come avviene per un Utente registrato presso ChatGPT. Le informazioni che l’Utente condivide volontariamente con i Chatbot IA presenti sul sito sono trattate come previsto nella privacy policy dei sistemi qui di seguito indicati. La base giuridica è l'articolo 6 par. 1 lett. a) e lett. f) GDPR. Il nostro interesse legittimo risiede nel poter migliorare l’esperienza dell’Utente e la qualità dei servizi offerti tramite il nostro sito web.

Nota bene: La Chatbot implementata nel sito può essere utile all’Utente solo ai fini dimostrativi e/o didattici. YouTube - modalità di privacy ottimizzata

Nel nostro sito abbiamo incorporato alcuni dei nostri video con la tecnologia fornita da YouTube.

Nell’incorporare abbiamo utilizzato l'opzione di “modalità di privacy ottimizzata”. Secondo le informazioni fornite da YouTube, con il codice "iframe" creato selezionando l'opzione di modalità di privacy ottimizzata, YouTube non memorizza le informazioni dei visitatori sul nostro sito web a meno che questi non riproducano il video. Quindi, questa opzione evita che l'Utente venga automaticamente tracciato da YouTube semplicemente visualizzando una nostra pagina web contenente un video. Questa modalità è accettata dalle leggi di alcuni Stati perché imposta i cookie solo dopo che l'Utente inizia a riprodurre il video selezionato.

La connessione a YouTube è necessaria per poter visualizzare i video presenti sul nostro sito web. YouTube registrerà ed elaborerà almeno l’indirizzo IP, la data e l'ora in cui il video è stato visualizzato e su quale sito web. Inoltre, salvo che i canali ove sono presenti i video YouTube non siano stati impostati AD free, verrà stabilita una connessione alla rete pubblicitaria DoubleClick di Google.

L’Utente dovrebbe essere quindi consapevole che scegliendo di non avviare i video non verrà tracciato da YouTube ma altresì non potrà vedere i contenuti video inseriti nel nostro sito.

I dati personali dell’Utente che sono necessari all’operazione verranno trasmessi agli Istituti bancari come parte dell'ordine così attivato.
